I'd agree if it was your own insurance comp paying for the repair.......but its not.....its the other guys....insist it gets repaired at a garage of your choice and they also pay for a hire car for you as well.....ive been there before and trust me you have to put your foot down if the 3rd party insurance comp tries to take the pee

Your entitled to a hire car, like for like.......ok so theres a bit of a problem there as no hire company will have an omega for hire......so just insist its a large saloon car thats auto (if the omega is auto)

Carnt see from the pics.....but is the rear alloy damaged? if so, insist it gets a full alignment check as well.

Last bit of advice......check your insurance policy to see if it has an accident damage company attached to it......if it has.....let them know asap.....they will do all the donkey work for you and make sure you get all your entitled too  :y

How do i know this......i make sure my insurance policies have 'Angel Assist' on them, they're an accident management comp.....costs next to nothing....bout £30 extra/yr......

Just to add, don't let them take the car without a written guarantee that the car will be repaired in full and returned to you. Under no circumstances should you release the car without this :-\

An alternative, if you can afford it, is to get the car repaired and invoice the third party insurers for the cost :-\

i will be very shocked if they dont write it off with the damage, car has been taken away now and put into storage i was looking to change it anyway so its just given me the push i needed, im staying with Vx but moving to the frontera 2.2dti for a while

As the "third party" you have a legal right to insist the car is repaired to it`s pre-accident condition

If you let the 3rd part ins comp do this, they probably will try......but you are entitled to have it repaired......if the 3rd party has admitted liability i would be screaming wheres my hire car by now!!

with a bit of luck they will offer me £800- £1000 for the car and that will do me very nice as i paid less than that for it 4 years ago the pics do make the car look a tad better condition than what it is

what i will say is i was due a change and if they do write it off i will get a better price for it (i live in hope)

that will be written off.the insurance company is under no obligation to put it back as it was,they only have to compensate you for your loss which obviously, is the value off the car. :y

That is the contract between YOU and YOUR insurers .. not between you and the third party insurers .. with whom you have no contract at all... they are obliged, by law, to put you back in the position you were 1 millisecond before their client struck you. You can accept a cash payout if you wish, or insist on the vehicle being returned to the condition it was 1 millisecond before the crash ... they cannot force any action on you. If they try just ask for a copy of the contract that you signed with them stating that you agreed to such terms  ......  as you never signed one they will have great difficulty in producing one....  and without said contract they have no power over you.

Big difference if you claim through your own insurance with whom you do have a contract and terms ...

Been there done it, got the T shirt and had the car repaired  ...  :)

Again some good stuff mixed in with some bizarre comments.

You do not have the absolute right to force any insurer to repair your vehicle.

To keep Zeeky happy, the below is a statement of the norm in the market. There will be some slight differences between insurers, but these are not significant and won;t alter the below much.

A vehicle is considered a write off where the cost of repair is greater than 60% of the pre-accident value. This is because the insurer pays you out, takes ownership of your car and sells the salvage for c40% of the pre accident value, hence the 60% figure.

Whether a vehicle is written off or not is solely at the discretion of the insurer. You don't really have a say on this.

However, given you are the innocent victim of another driver's negligence (based on your OP) then the other drivers insurers may be more sympathetic to your plight. This will depend on the severity of damage, the ease of sourcing parts to repair your car and the pre-accident value. If the cost of repair is just over the 6-% then they may be willing to discuss it; if it's higher then there's no chance. Categoridation of write offs (google it) also complicates this as a Cat A or B will not be allowed to return to the road and you will not be able to retian salvage.

Some will now post about how they did XYZ and forced ABC to happen, please take this with a pinch of salt. Ditto with any comments around the FOS, they'll tell you to exhaust the complaints process, will probabyl take 9 months to rule on it anyway and if the figure is well in exces of 60% then will not rule in your favour.

Some time ago my car (not an Omega at the time) was parked on the street outside my office.
There was a bang and a lady in a BMW had gone into the side of my car
She remained sitting in the car and would not get out
The police were called, and still she would not get out
The fuss got bigger and bigger, with more and more people
Eventually her hubby turned up with an overcoat which she put on inside the car and THEN she got out.

So why ?

She was wearing beige trousers and when she crashed into my car she'd wet herself which was very obvious. She would not get out without "covering up"

Morale of the story: Don't drive stupid if you need a wee  ;D

he was driving a transit pick up collecting scrap he will never be out of work the way he drives, the recovery company have said its looking like it will be a totaly loss on a cat c so i can get the car back and take a few of the goodies off ie fuel pump, battery which is new, cruise control to name a few

That could be fixed and back on the road in a week...
