Title: Some advice please

At work i have a protected earnings limit of £639 a month due to csa,as ive been of work sick they went into my protected earnings to pay this,they are saying they can do this which the legally can not do,does anybody know how i can get this sorted out as payroll are being idiots and saying they can do this.

I think the best port of call would be the CAB if you can get in to see someone :y

"Protected Earnings
Where we ask you to operate a DEA you must consider what is known as the Protected
Earnings amount which is an amount equal to 60% of an employee's net earnings.
This means that for each pay period where a DEA calculation is applicable, you must
additionally ensure (after adding the amount of the DEA to the total amount of other orders
that may be already in place) that your employee is left with at least 60% of their net wage
."

Thanks for the link,ive already sent that to my branch manager,im off to c.a.b in the morning and will be getting some more advice,not the 1st payroll have messed up my wages and denied it.

Been down to c.a.b and they gave me some more info and said they are not allowed to touch my protected earnings,they also gave me a number for acas,just spoke to them and given me another number for minimum wage etc,so on phone as i type waiting to speak to them.

Ask employer to set out in writing the reasons for the action they have taken. Get a copy of grievance procedure and make sure you follow the system set up - probably your manager in first instance but may be Human Remains dept.

I gave the csa a call,told them what happened and they are taking this seriously,contacting payroll direct and reading them the riot act,and getting the money taken off me given back to me,makes a change for them to be so helpfull.
