Title: Employment law.
Post by: pauls on 24 November 2014, 21:45:51
Does anybody know if this is correct.
On starting work signed contract to say 24 hrs fully flexible for shifts between 7am to 8pm. 3months in verbally changed shift to 3 x  8 hrs. Late shift only Been doing same shifts for 2 years.

Been advised company cannot revert back to orginal contract and cannot inforce it. Is this correct or not.

My understanding is, your T and C of Employment or Contract of Employment can only change without your consent only under special circumstances. Quick visit to CAB might help here.  :-\

The verbal change is open to interpretation. Employer may argue that there was no intention for that to be permanent and contractually binding (hence not in writing) and that full flexibility is what business needs etc. There is obviously a lot more detail to this and whether the change after 3 months can be evidenced in some way (eg by others) it is difficult to advise further.
