Title: Damaged when parked outside

Not me but my daughters y reg mondeo . She came out this morning to find a note from a local schoolkids minibus

driver with his companys details.  N/S rear light cluster  smashed , rear bumper hanging off & some local paint damage.

Can she just claim from the drivers company insurance without getting her insurance company involved ?

The car is very low mileage for year & has been in the family from almost new & well looked after.

Can she demand the car is repaired ?  any advice apriciated  :y

Abosolute best case, as theve already admitted liabilliaty by leaving thier details, you can demand that the full Cost of Repaires to your satisfaction are are paid and covered by them, this can be done in two ways -

1. You submit a Quotation for the Cost of Repairs and they front the Cost in Full prior to the Works if paying you directly, or they agree to to pay the Repairers directly using an agreeable method between them and the Repair Co. either way you will need to get something in writing that leaves a paper trial so that you still have a legal claim of sorts should it not go to plan. If the Bus is run by outside Contractor, which is probably the case, then then Bus Contractors may suggest they cover the Cost by using there Own or there Approved Repairers directly, but your still need written confirmation prior to the event.

2. They dont want to play ball on any of the above, then you inform them you will be going down the Independent Insurance Assessor route, the Insurance Assessor will work on your behalf without involving your Insurance, He will (or Should) claim his full costs and yours against their Insurance Co, and your probably find he will also claim additions, like, Hire Car or Travel Cost, Loss of Earnings etc, whilst the Car is undergoing repairs.

Yea, but if there PSV Insurance involves Transporting Kids, it will be cheaper for them to fix it, than bother their Insurance Co.

Transporting, children,fluffy bunnies or kittens has got swfa to do with a minor traffic collision,,,  unless your a daily mail journalist.

.. and their insurer won't want to deal with you directly, so probably best to pass the details on to your insurer and let them deal with it to save you the hassle - unless the operator are prepared to pay directly for the repair.

You should tell your insurance anyway. Let them deal on your behalf, job done. It’s what you pay them for :y

Reason you don't want to involve your insurance sometimes, is they will write the car off,  hence deal with the other parties company if they won't pay for repair, most large transport companies would rather try to sort the incident,in house,to keep there premium low. 

It can be more cost effective to pay directly, than involve insurance..

Al, if you report it to your insurance company, thney will hold it against you somehow (I know, from bitter experience), either on a knock-for-knock basis, if they can, or in your next premium.

Found that when Swinton sent me the next years renewal notice after mine was written off. Went from under £200 to £350 +.

Yes, they are happy to collect your premiums, but so reluctant to pay out.

Y reg mondeo  :D  I'd just get a cheque off them gaffer tape up the damage and spend the money on something else  ;D
