Title: Complaints Made
Post by: SheWhoMustNotBeOUTBID on 06 November 2008, 14:00:35
Because we have been working on cars, it looks like a complaint has been made (we live in a Local authority property).  We're always very tidy, no car has been left looking in a 'for breaking state' (we move those to the garage before we start) but complaints have been made that we are repairing other people's cars (not true at all).

Anyone got any idea's?

Know we need to get premises but its a bit early to be able to afford that.  Only been working on cars we own.  Sold two but that's all. Must admit the Range Rover looked a bit awful when it arrived but obviously its now in a cleaned up state and looks fine, altho still being worked on.  This is ours and will stay ours but I reckon its what's caused the problems.

You know what people are like.  Have you got/or get permission to work/trade from home from the councel.

If so, tell em to stuff it. :y :y

I know, I seem to remember that u are not allowed to run a business from the property so we could be on sticky ground.  Haven't done what is being complained about tho.., any repairs have been done away from here.

Someone two doors away lost their garage cause they were repairing cars for money in it so been very careful about that.

Are you running a business?

I though you were playing with a few cars as a hobby, and earning a few (declared?) quid on ebay at the same time ;)

At our first house I had a dumped car warning on a car belonging to me parked VERY near my house.

The council got a very snotty call!

That's the approach I was taking, but Julian has been telling people what he's doing and I guess he's been overheard.  I have tried to shut him up lol.., but its not easily done :P

Downside is most councls dont like major car work being done, maybe worth applying for some sort of permission.  Then if someone comments it will not make any difference. :y

Wolverhampton Council are T*!#S!!! I have a friend who had a privately owned house in Wolvo, he'd slowly been restoring 2 Morris Minor's, one for him and one for wifey. Neighbour complained that he was running a business so council, without contacting him, took him court for back council tax at business rates! He told them in court to get bent and promptly sold the cars and the house! He now lives on a narrow boat in the Norfolk broads. Aparently the council are still looking for him  ;D ;D

lol, I think ultimately it could get difficult, but I hope we don't end up on a narrowboat lol.

Can I ask a few questions? You may not want to answer them, but it may help us give a more comprehensive bit of advice...

This is not by any means a dig, I promise, I'm just trying to look at it from the "other side of the coin" purely to help you decide what to do for the best.

1) You say Jue's given up his job in order to work on cars from home. Is he registered (with HMRC) as a sole trader or other form of company?

2) Taking number 1 into account, is the work being done from home?

I suspect based on what you've said the answer to this is yes - have you registered with the relevent organisations that you are conducting business activities at your premises?

3) Are you working on the cars on a driveway, or on the road?

Just be careful, if you're not fully legit in many areas, people will look for these weaknesses in order to strengthen their complaints... :y

OK, I take on board what u'r saying.  Its not quite as simple as that of course but will take what u are saying into account James as I make decisions.  Guess Jue may have to sign on again.., funny old life isn't it?

Please, please don't take it the wrong way. As per post above, I'm not digging, or prying - just really trying to help ;)

yes i have had a similar issue with my landlord! have requested a court hearing about a yr and a half ago and am still waiting!

our tenancy has clauses built into it like not running a buisness out of your home etc cars must be taxed and in roadworthy condition!! rediculous! but if 1 person complains then they wont investigate it they will just send a snotty letter out!

i wish they would start eviction proceedings against me though but they wont  >:(

some neighbours are a rite PITA i currently have a "Problem Neighbour" i wish if people had a problem with something you were doing they would tell you instead of hiding behind the police or landlord!

I've had complaints from my neighbours when I was buying and selling and to be honest, I can understand where they are coming from so i've calmed it down now and only do close families cars :(

I can to a degree, but, if there's

No mess
No excessive noise
No working at antisocial Hours
No "eyesores" Eg cars being broken

so on and so forth...

I don't think it SHOULD be a problem..

People like something to complain about, it's just a fact of life :(

James raised a similar thread recently, can't remember the exact outcome but iirc there is some law agianst working on cars on the road, unless it was to get the car going again.
Perhaps someone else may have better recall. ::)

James had trouble working on his Estate outside Maria's (think it was the post with the bit of rubber in the bore).  The guy accross the road said he was going to report him to the Police for working on the road side.   :-/

Can't comment on that as I do not know the area, but many busnisess run from private and Council estates, how many ebay busnisess are out there. Rules should not stop a person from lifting themselves off the dole and into work, even if self employed, as long as you can keep the neighbours happy.
we drive into Darlington regularly and always pass comment on an affluent area, one bungalow has a large front, walled, garden full of cars and vans, looks like a scrapyard...... ::)

From what I have read on the agreement then it looks like it's a case of inform them in writing to gain permission, like building a garage before gaining permission.  They would just come along and tell you to take it down and then refuse to give permission to put one back up.  plus leaving you out of pocket.

Basically controll freaks.

I used to do a lot of work at home (Council estate but I've bought my house) and I even scrapped cars but I always made sure everyone knew what I was doing and I always arranged for my local friendly car recovery man to come and collect the shells when we'd had all we wanted as soon as we finished (sometimes to the hour!). I even went around and swept up afterwards. In fact the our area was cleaner then when I was doing all that than it is now!

As has been said, I think it's when people perceive that you're working from home, whether you are or not, that they get the hump. As has also been said, loads of people run businesses from posh houses but they're in a room inside the house that no-one can see what's going on so that's ok then!!

And as for cars without road tax? My neighbour had an Xr2 (going back a bit!) for eighteen months and never had road tax the whole time she had it >:( My Missus used to tell me not to worry about it but of course if she wasn't taxed the likelyhood was she wasn't insured and that's what bugged me.

Anyway, climbs off of soapbox :y

In Bradford they reckon 6 out of 10 cars are not insured in certain areas , so needless to say I never drive there unless its absolutely necessary have driven through in past.cars do not stop at minor road junctions there just beyond belief!

I feel really sorry for you.
People in this country are expected to go and do a wage slave 9-5 and drive a modest car, live in a barrat home and not rock the boat.
Anyone who transgresses this norm will be harranged and persued by the powers that be, who we all pay too much for.

If they ask you anything deny it all, it is almost impossible to prove that you have been running a business, say it is your hobby, and you promise to be nice in future.  Then go and rent a unit somewhere quiet and continue.

Breaking without a licence is viwed seriously now, a licence requires about £50k worth of gas and oil segregation and recovery equipment.
If the environment squad get a wiff of breaking you will be fudged!
I would get a unit, buisiness rents are dirt cheap at the mo as commercial land lords are bricking it, and open up as a Garage, no mention of breaking, keep the cars coming in one at a time, break and shelve the parts and move on, if anyone asks it is always a customers car being worked on.

A very good friend of mine fell foul of exactly this and it cost him dear in fines, another bloke my way has been breaking Jags for 25 years and gets away with it.  Unfair but true, learn the game and play it.

Good luck to you both, busy bodies will get their's, don't you worry! :y

Once out of the woods, ask them how much council tax are you paying that they have so much in savings that they can loose millions in IceSave and still empty the bins?

Jobs-worths have screwed the modern world for us all... :'(
