Title: declaring bankrupt

how is someone with no income - only recieving child benefits supposed to come up with the money to declare themselves bankrupt? i.e. £400

surely the fact that they have no money to pay off these debts mean that finding £400 may be a bit of a problem?

any advise

Ask the advice of Citizens Advice Bureau, they should be able to help :y

You could get one of your creditors to do it for you. They then pay the fees.

I would definately seek advice. CAB have been good for me in similar circumstances.

whats in it for the creditors if she is declared bankrupt?

do they get money from the courts or something?

dont pay to bankrupt yourself....let one of your creditors do it......CAB should point you in the right direction  :y

I second that!!  They are very good at giving excellent advice on debt management and will know exactly what can or cannot be done and for how much! :y :y :y

she tried going in there a few weeks back - she waited 2 hours (in which time she was left while the person she was seeing went to lunch)

when she came back she was told sorry i cant see for this you need to make a long appt - but that because she now has a new partner the the debts would affect him and they needed to see all the partners in-going and out-going's.

good advise on letting the creditors make her bankrupt - question now is how she goes about it - another trip to the CAB

i know it sound funny but have you got any balance left on a credit card etc? :-/ i know people who have gone the same way and borrowed the money to then go bankrupt.  or borrow the money from a relative and name them as a creditator, they may get some back as an agreed payment plan.

its not actually me - she aint got a credit card so thats not an option - i think the creditor route may be an option - they wont be able to sell the debt on cos she doesnt have any assets or savings

letting a creditor file for bankruptcy,  ie: dont pay them..........eventually they will will file for b/ruptcy - b ut be prepared for a bumpy ride...it aint pleasant  :(
OR go for an IVA........Independent Voluntary Arrangement
just google IVA..................should get sites there for info - HTH

cant you get fee remission from the county court ??

i helped an elderly neighbour in my estate with a small claims court claim as he got tax credit he got a fee exemption!

there are 2 charities who will talk to anyone with financial difficuties:

CCCS is one of them www.cccs.co.uk

Payplan - www.payplan.co.uk

these two are completely free and will give good quality advice

CAB are good but here's the catch

CAB will ony deal with/ help you if you have:

1 debt of no more than £5000, they are not equipped to handle any more than that.

CCCS and Payplan are excellent and will be able to deal with multiple creditor and any amount of debt, they will sit down and complete an income and expenditure (I&E) form, from there they will be able to help.

PLEASE DO NOT USE ONE OF THE COMPANIES WHO ADVERTISE, THEY CHARGE LOTS OF MONEY

And they WILL encourage you to use any source of finance you have left, are you aware that is fraud, you are borrowing money to complete a closure or financial matters that is detrimental to the lender.

How do i know this.....i spent 12 months working with the collections department of a major credit card company

Not strictly true. They are still happy to give you general advice - and that was still very valuable in my case. (Which is way above the 5k you quote...)

But I appreciate that they may not want to take any responsibility for dealing directly with creditors or debt plans.

its not easy to go Bankrupt these days, you have to prove you have not squandered your money, if you have a business thats gone under then that acceoted, but if you just maxed out the cards then quite often you wont be granted bankruptsy

The state doesn't pay for bankruptcy. You do. For 3-5 years if you are earning.
