Hi,
Just caught the ad on TV from the DVLA about insuring your car, and if not must be declared off the road. My 3.2 Elite is off the road the now, taxed and MOT'd, just not insured. Does this mean im likely to get a fine through the door? It might be getting re-insured in the next week or so and as such I don't want to go through the hassle of sending tax disc back, SORN it, then have to re-tax again
Is this right :(

you're correct, don't know how much lee way they'll give you. You'll lose money if you SORN & then re-tax it >:(

Hmm, wonder how long it takes for the fine to come through then, been un-insured for a few weeks. So everytime I want to put a car off the road for a week or 2, send tax back and declare SORN, then have to re-tax for 6 bloody months. Nice little earner that

Guessing its cheaper to insure for a year than occasionally insure for a few days regularly.
Hence I think the new rules are a good idea (as many scrotes insure to get the tax, then cancel the insurance, and drive uninsured)

I usually have 2 cars on the go but both have been off the road to get various work done so I have just been swapping the insurance over as I will be getting rid of one of them soon. Guess i'll need to take the hit if it comes or try and sell one minus tax :-/

Read somewhere they do checks through the MID (motor insurance database). With that system it takes a day or 2 to get updated, if they were to do that random check in them couple days and issue a fine! It won't stick... so I think the same procedure they use on untaxed vehicles will be applied which is, if they spot your car on a public road 1st of the month it will be recorded, if the vehicle is spotted again at the end of the same month then you'll get a fine or have your vehicle towed. As this way they can prove it WAS on a public road.. ( But in this case through MID)

But the point of the new legislation is that it doesn't have to be on the public road any more. If you are the registered keeper of a car that's taxed but uninsured you're fined by post.
Meanwhile, those who have no intention of paying for either carry on as normal. >:(

I believe they will have no way of fining you until the end of the month. Reason being if you send a tax disc back you get a refund. But only for the full months left. So rightly or wrongly you have until the end of the month in which your insurance ran out before a fine is issued.
That is of course completly unofficial. And is open to interprotation. For example it is in the post etc. If they decide to pay you a tax disc refund on a daily basis then it would be a different matter all together. However that is unlikely to change because of postal delays and delays in processing their end.
It is just another way to try and stop people selling cars privatly with tax and mot. They want all sales to go through car dealers, then the next step is you cant drive the car off the forecourt until it appears on the MID.

Cushy. Try living in a different EU country. e.g. Spain
Cars have to be insured. period. Refunds for part of year are unheard of. Cops have in car access to the insurance database which apparently is more accurate than the UK equivalent.
Tax is paid for a whole year by whoever owns the car on a certain date. Refunds? Only if the car is scrapped and then you get either 6 months or nothing if less than six months to run.
Oh and there is a hefty percentage(say 4% of government book value) for buyer and seller to pay the government each time a car changes hands and it must have an MOT or can't be sold.

Fair enough Kevin, but i think its still in the trial and error period although they say its started from april this year??

I've no doubt they delay for a while before starting to send threatening letters, if only to avoid their own administration costs chasing people where the MID database update was just a bit slow.

The MID database isn’t infallible to mistakes / errors. Although the police will go by what they are told. And I've heard of two cases whereby the Police pulled drivers over, tell them they’re not covered by insurance when in fact they are, seized the vehicle and the person has still had to pay the release charge to get it back, even though the information was incorrect.
Another example, dvla have my car registered as a 3.2 special on the v5 and their records, yet when trying to insure via the internet, upon entering the registration, it always comes up as a 3.2 elite :o

I doubt it to be honest Stallion, as the spec of the Mig's going to the Police were basically GLS (basic) spec direct from the factory. ;)
