Thats why i never commented on this..Things dont make sense. On the welsh news tonight 2 people got fined £7000 between them for selling bluebell bulbs, you wont get fined that much for more serious crimes just a slap on the wrists.. :(

I am sure Hotel21 will be able to explain what is 'aggravated vehicle-taking'?  :o

I thought aggravated vehicle taking was along the lines of carjacking, or threatening violence to steal a vehicle, as opposed to trying to steal a vehicle without being seen..?

how did the subject of internet come about in this thread? did spongebob (the great) reply in the wrong one?

Sorry Peeps, missed this!

Aggrevated vehicle taking is an Engerlish thing that we dont get north of the wall we built to keep you lot out.....   ;D

I interpret it as per above - using violence of one sort or another to take the vehicle, either by a physical assault or breaking into a house to steal the keys or similar.

Perhaps some of my English colleagues could elaborate?

If the vehicle is taken with the owner's knowledge, the owner has consented. But apparent consent can be ignored if obtained by a deception, e.g. giving a false identity when hiring a car. This overlaps with the s15 offence of obtaining property or services by deception. Taking by force may be robbery when the defendant did not intend the victim to recover the car at all or so seriously damaged that it amounts to a theft (see s6). If the evidence is insufficient for theft, the alternative charges are aggravated vehicle taking or blackmail under s21. Note that s12(7) protects the interests of people hiring or buying under a hire purchase agreement by deeming them to be the owner for the purposes of s12.

This part of the charge was dropped, seemingly because the driver gave up his position before the case. He was a delivery driver for a car hire firm. Will not be doing that again in a hurry... ;D ;D ;D
