« on: 26 August 2010, 11:37:15 »

...and he has had an ear full from me.

Caught drink driving (don't know how much over, but over).

Not insured to drive car, but car was insured.

No MOT on car.

What's the likely outcome?

Obviously they will receive a ban of at least 12 months and a big fine.
Also, if the owner of the car knew they were driving without insurance then they are liable for aiding and abetting....

The owner of the car didn't know they were driving as they are not allowed to drive due to a stroke, so one can assume it is taking without consent?

Quite possibly... If he shows remorse he may only get done for the Driving under the Influence.

The car will probably get seized and if not collected, after payment of the fees, crushed/sold at auction. There will be storage charges to be paid too ;)

I suppose if the detecting officer wanted to get stuck in a TWOC could be considered although in the circumstances I would just report the DIC/DD, insurance and MOT offences. (if I were still in uniform)

If the blood/alcohol ratio is above the legal limit there's a mandatory ban from what I remember, points on licence, fine and so on.  The sanction applied to the DIC/DD offence would be the one that would cause most inconvenience for him.

A bit of backround here;

That just about covers the criminal side of it. Then there's the endorsement that stays on his license for eleven years, a possible re-test after the expiry of the ban and the fact that most insurance companies won't touch him..unless he wants to cough up thousands of pounds.
