Potholes..!!!

Earlier in the year, I hit a pothole(sadly it was unavoidable) which damaged both wheels on the nearside of my beloved miggy...

I took photos, got a witness statement, reported the pothole..  and put in a claim..

Eventually after 6 months I got a letter from the councils insurance saying they won't accept liability..  apparently the pothole wasn't there...

Does anyone know what I can do...??

Find where the council leader stays and slash his tyres ::) ::)

Contest it as you have photgraphic evidence and witness statements.

It might be worth going to see if its been filled in....if so take a photo of the repair.

There is something about the depth of the pothole as to whether or not a claim is admissible before the Council . It is odds on that the pothole in question had been a source of exposure financially for the Council and so they fixed it. If it has been fixed I would request details of the repair under Freedom of Information in order to get at the depth of the repair, the date of the reapir, the repairer etc to compare against your date of loss.

Perhaps the moved it - that's what they seem to do where I live  ::)

Seriously, if you have evidence, hang in there like a Jack Russell.  Threaten County Court (i.e. small claims) as that is cheap for you and expensive for them.

I heard something about this last year. Wakefield council, along with others, were being insured by some obscure American company. These insurers were flatly refusing to pay legitimate claims and dragging it out, sometimes for years.

Find out who your council insurer is and if it's an obscure Amer...................you get my drift.

The pothole was filled in the day after i reported it....   and it measured 43 in long, 18 in wide and 5 in deep....

So it wasn't a small one...

And the insurance company is a major one.. Zurich...  So i might go down the small claims court way...

Plenty of similar cases to read about on pepipoo. com.

Most, if not all, claims settled out of court.

;D ;D they do that where i live  but instead of eventually filling the pot holes they put a speed hump over it ;D
