mrs car been playing up so was looking for something to replace it and found a cheap runaround.paid with paypal just been to collect and the exhaust is hanging off and its got a damaged front bumber and light that wasnt shown in the photos.seller says take it or leave it so i thought id leave it and get my money back from paypal. so came home but have just found out that paypal dosnt cover car sales
so watch out
ps any advice?

Small claims.court is your only route.  Normally the registration phase is enough to make anyone relented.  If you do make sure you also claim for interest on the money, cost of travel, time and damages.  Be realistic but make sure that they add on a few hundred quid.

Pay cash on collection.

We were interested in a BMW Compact that was up for auction on Fleabay, it was described as '60,000 miles, mint condition, no faults' so we contacted the vendor to make sure there was no rust on the vehicle and to confirm it's condition. We bid on the car and won the auction. When we turned up to collect it was obvious that the car had covered many more miles than indicated, the rear tyres were bald but I only discovered this after nearly loosing the back end pulling off from traffic lights, the suspension was knocking -Matey boy had a few new bushes waiting to be fitted so he obviously knew about that fault- and both rear arches had rust on them...
Needless to say he didn't get our money.

yes you are covered
if you have not recieved goods then you should be able to demand a refund on any money spent

the car in question was obviously not fit for purpose so if no joy from Paypal

Get some mates and go round get the clowns house get him on his own and threaten to beat the s**t out of him unless he hands the money back.
Ive done this before you have to be tactical about it and have witnesses lined up to say you were with them if you get my drift .

yeah thats what i would like to do but iam not that sort of person.
it also turns out that the person with the ebay account isnt the seller.

yes you right i just paid by paypal as i thought you where protected,when in fact you are only covered  on some items.
still you live and learn.

the article is advertised and a buyer accepts the contract of sale and pays according to the terms demanded by the seller.

if either side does not follow the terms of the contract, then he is in breach and can ultimately be taken to court.

the seller has breached the contract - quite clearly.

if you paid via paypal and it took the balance from your credit card then you should be covered as it is considered a retail purchase on the card irrespective of whether or not the sales merchant was paypal. obviously you'd need to take the claim/issue up with the card company.

you are quite correct,but most things you buy on ebay you dont see till they arrive and i thought  that if things went wrong you where covered by paypall.

As you say mate, we've all made mistakes, and you won't be making that one again. It's a shame you lost out but don't beat yourself up

I've bought several cars blind on eBay but never, ever pay in advance... Always cash on collection
