weird insurance dealings.......

my mother in law has recently had an accident with a van shunt her rear, all healthy after tho'. she has gone through the insurance and they have said its a write off without looking at it cos its 10 years or older?  they also want every piece of paperwork when they pick it up from her. she has spoken to the insurance and they seem a bit confused about the whole affair- so ive advised for her to contact the legal dept which she is covered with!  they have not even offered her a courtesy car? what a shambles- needless to say it will be me who will be doing all the running about on this one...........................
any of you bods in insurance? she is fully comp so whats she entitled to? 1 not her fault 2 its a p reg 3 it looks like a big crease in boot base 4 and she needs to be on the road. cheers tone.

Well.....im not in insurance....but i think she should be entitled to a loan car.....unless they have already made an offer for the write off.....i think thats how its works  :-/

Not all insurance companies offer a loan car, even on fully comp.

She really needs to talk to her insurance claims dept, every day at least!
Hassle hassle hassle, they mess us about, so she needs to make as much noise as possible in order for them to hurry the claim up close the case and get rid of her.
I used to work for a large ins co many moons ago, when my sierra was stolen, I had a fresh cheque in my hand one week after first reported, due to...........being a moaning crabbit b*stard!

It worked.

But honestly, she has to be on the phone every day.

R.E hire car, if she asks her ins company, she might be able to get them to arrange something, or if she pays for it first, she may be able to be re-imbursed via cheque at the end of the claim.

this is why some insurance companies charge through the nose, believe it or not its because a lot of the time they'll treat you like royalty, they only appear to rip you off if you never need to claim cos you wondered why you needed to pay so much!!

you pay very little insurance, you get very little cover, even fully comp!

like we hear all the time, you never know how good your insurance company is until you make a claim!

I had a no fault claim last year. I got a hire car had to pay for it myself then claim the cost back off the other party. best thing to do is to speak to her insurers and get them to sanction it .

o.k. question is whose fault was it?  If it was the van driver then her insurance has nothing to do with it, she should claim from him.  Whether she has fully comp, TPFT or even third party only doesn't matter.  Van driver at fault, he pays.  

His obligation is to put her into the position she was in before the accident.  Usually this means the value of the car but the other driver's insurance can repair if they think it is economical.  She should also claim for inconvenience, hire car etc from the van driver if he was a fault.

Her insurance company should help here.  If the van driver's insurance does not pay up then IF she is fully comp then she will claim under her policy.  THey don't want that so try to hassle them into pursuing the other drivers insurance.

As to the paperwork when they pick it up:  they become the legal owners when it is written off so they want all that stuff as well

Finally, as a general principle if the insurance company has made an offer for the write off, then argue with it.  There will almost certianly be some room there for improvement if you persist.
