s/h van
« on: 24 June 2013, 11:14:51 »

my son is in the process of buying a van from a garage ( berlingo type ,1.9 diesel ). price £1500. + an additional £100 for a service. he told me this morning that a deposit of £800 has been paid, but when he picks it up it will need a m.o.t as it does not have one. I may be wrong but I always thought a garage have to sell vehicles fit to drive , that includes a current  m.o.t, & are liable to a parts + labour 3mths warranty irrespective of age of vehicle. can anybody enlighten   me on any law re used vehicles from a trade outlet such as a garage please.  :-\ :y

This probably comes in the form of a spotty seventeen year old with a damp cloth.......some garages like to be pretty vague with what they refer to as 'a service'

The MOT means diddly squat where roadworthiness and vehicle condition are concerned, the ONLY thing it proves is that the testable items were working when the test was conducted.

Being a van, not sure if consumer rights apply, as it probably comes under a business to business transaction?

I would get my deposit back and go somewhere else unless they put an MOT on it and no extra charges  :(

Don't know whether it's law or not but any decent garage would M.O.T. It should be "fit for purpose" surely?Don't vans also attract VAT on top of asking price?personally it would be M.O.T.or buy from elsewhere.

Any normal garage would put an MOT on it, I'd be dubious if they aren't.

Credit where it's due, the rust more slowly than an early Combo ;D

Agreed though, not Moting it at that price is a bit on the tight side :-\ best check that the sticker price does include VAT while you're at it :-\
