Son caught speeding

My eldest just got caught speeding on the motorway, basically the scenario is, motorbike up his arse, Golf in the third land, and the two other lanes are completely free of traffic. Anyway Golf moves over he goes past then slows back down. The bike behind him turns out to be an unmarked police bike. Basically it shows him doing from 80-90 MPH for the duration, then when he passes the Golf he got up to 103 for a couple of seconds then he slows back to around 85 MPH. They've said to him they've got to send it off to the court so they decide what to do. He could obviously receive a ban for this, is it likely he will?

Was always led to believe that if you passed 100mph its an automatic ban, unless of coarse your Sir Alex Ferguson and need a piss. Money talks unfortunately.  >:( >:(

6 points if he is lucky  :(
28 days off the road if the judge is having a bad day  :(

Hope he gets his story straight and eats lots of humble pie / I could lose my job ect  :y

Groveling does work, I got tugged doing 96.92 on a B road  :-[
Got away with 6 points and the bollocking of a lifetime  :-[


Edit to say I was 28 years old and had a clean licence at the time

That's my other son, eldest got caught speeding, youngest is our discussions :y

I hope he doesn't get nothing to serious, he's got a little one on the way due at the end of August, and where he's moving house, he needs the car for work.

I hope he doesn't get nothing to serious, he's got a little one on the way due at the end of August, and where he's moving house, he needs the car for work.

Selfishly, good news... I'll be in touch with you/him later for a chat and some details ;)

As for the other son... He needs to be humble and (if it goes to court) admit the offence immediately and make a reasonable representation as to the adverse effect it will have on his life ;)

at the worse he is looking at a 3 month ban (this is the minimum they will hand out) and 3 times a month salary fine trust me i know about thus...what eviedence have they got??....video??

Video, he's watched it, and seen it says 103 for about two/three seconds then returns down to between 85-90.

expecting anything other than a ban is almost certainly wishful thinking......     if he'd just moved over with the golf to "let the bike past"      it would not have happened.....    lesson about to be sorely learned i suspect...... 

sorry......     sucks,    but it is a lesson in "intelligent speeding"

the law says what it says,  it doesn't anywhere say "thou may safely do 85-90" without fear of being nicked".....   so even if he had only gone up to 99,  he could easily still be looking at a large slap on the wrist.

best not drive to court......

Anything more than double the limit (eg, 60 in a 30) or doing a ton or more is an automatic ban unless the driver can prove extenuating circumstances.

That's into ban territory really. Only hope you really have is he only sped up for the duration of the overtake then slowed down again and that is accounted for. At which point I presume he slowed down and kept with the traffic flow. They will however argue that he was still speeding in the first place, even if he was just keeping with the traffic.

Going off the magistrates guidelines (and depending how the judge feels whilst getting outa bed) -

A court summons will be likely, a fine of at least £60 and between 6-9 penalty points. It is possible that an automatic ban will be received due to topping 100mph. But if you plead for your license - need it for work, family commitments etc. the judge MAY be lenient.

May also be impossible to prove. ;)
The fact that the copper is apparently reporting the fact that he exceeded 100mph,suggests to me that he is going for the ban.
Otherwise,he could just report a speed of ninety something ans a ban probably wouldnt be on the cards.
