another E bay question?

whats your opinion on this one everyone.

bid for & won a JVC CD/radio last week (weds) . Won it for 4.99 ;) ;) as no other bids .

Paid by paypal & seller messaged me to say thanks & he/she would post it next day.

This morning have a message saying that I will be refunded as the item was returned to the sellers address "Badly damaged"

I am thinking that surely once posted it would have been delivered to me in the damaged condition .

Post was 2nd class standard delivery.

I have now asked him for proof of postage as I am thinking he does not want to part with it for a fiver  ::) ::) ::)

once paid for by me & posted by him ,surely the item becomes my property & it should be me who is claiming from the PO.

I have recently had a spoiler for my sons car damaged by the post office. I claimed succesfully from the post office.
That was from an ebay seller.
Likewise I have just sold an item on ebay for 99p (gutted) by I have sent it by courier (DHL) but it has not been delivered, I have full tracking info for it and it just says "on hold" They tried to deliver it next day after sending. I suspect I will be hit for a claim. And all for 99p and 5.95 postage.

But yes I would suspect that once posted it should be delivered to you in any condition, the only exception being if the address label was badly damaged and they had to open it and hope to find the senders address.

well the way it worked when i worked for royal mail was once the parcel/letter has been left in post box/post office the receiver then becomes the customer .... :y

As far as I know Royal Mail will only consider claims from the person who bought the service (the poster).

Although the Royal Mail in this neck of the woods (and Parcel Force) is very good, delivering a quick reliable service, I've found that the larger or heavier the parcel the more likely it is to bear damage.  Having said that, I've never had any expected delivery fail due to damage being caused to the packaging - and I've had boxes delivered here hanging open and the contents smashed up (mostly by the non RM couriers I have to say) .

Although it's not beyond the bounds of possibility for damage such as you describe to happen, it seems fortuitous in this case that, despite the package ‘badly damaged', enough information remained to allow its return to the poster.

As this may be difficult disprove, I would take the refund but keep an eye on their future listings in case a similar item appears for sale again – for your own information more than anything else, as the vendor could argue that the item in the ‘new’ listing was another radio of the same type to the damaged one. 

If something like this should happen, and it irks you, I suppose you could bring your dissatisfaction with the vendor to the attention of eBay – just in case there have been other complaints against them not evident in the feedback score.

Insofar as the subject matter of your op is concerned I don’t think there’s any point in raising a dispute with eBay as the auction was closed out with you being the successful bidder and, despite the unsuccessful conclusion of the transaction due to the failed delivery, you’ve had a quick refund of whatever money you have paid to them.

My opinion too . . .   just don't know if it's worth all the hastle though .  Probably just keep a look out for another  :y
