cheers BM. But aside from the offer.... it sounds like a situ where if I let them take it its highly likely im not going to get it back. I think they'll just deem it ''unsafe'' and scrap it.

as said im not having this car scrapped. its my baby :( :'(

You have every right to keep that car and every right to take it to your preferred place of repair and have them quote for the works necessary.

Let's be honest, it is probably going to be a write off when part prices are taken into consideration so, IMO, you are going to do well out of the deal.

The only problem I can see is the rear light lens and loose bumper (jaggedy sticky out point bit) would make this car technically illegal to drive on the road.

Don't back down and demand that you stay in possession of the car at all times.

Webs - get a quote for repairs from someone you know and trust - write to the insurance company stating that as it was their client who hit your car, and are therefore to blame, you are enclosing a quote for repairs.  Give them 7 working days to respond and agree with and cover the repair costs quoted, or you will go ahead with the repairs and take them through the county court to recover cost of repairs and out of pocket expenses.

Do NOT let them remove car.

just shows though that for someone who don't know what theyre doing (ie me) it could have all gone pear shaped and I could have lost my car

As far as I'm aware, they cannot dispose of your car unless they have your permission.  The problem is how they treat your car when it is not in your possession, i.e. getting moved around by a bloody big forklift!  >:(

I guess it depends on what YOU want the outcome to be. 

1) If it were me, I'd hope that the car was beyond economical repair and they sent me a nice cheque.... that's only going to be a Cat C anyway, so stick some shiny new bits on and away you go.

Or

2) It ends up being repairable and let a Garage make a tidy profit on repairing your vehicle, you get the car back (as in scenario 1) but don't have a few hundred quid in the bank.

Quick update guys. This gets more ridiculous by the second! lol

I called the repair centre in Luton. They were like ''yeah if you want the car back that's fine irrespective of its safety''. ok, great. but...

We will charge you 30% of what you get from morethan to effectively buy the car back from us. in his example he said if I was to get £1000 from more than they'd obviously take £300 and i'd have £700 to do the repairs.

that's all well and good but when I spoke to morethan they were like ''yeah we'd probably offer in the region of £300''

HAHAHAHAHAHAHAHA

So for all this hassle they come get my car, give me £300 which I then give straight to the repair centre who then return my car with no work done and ive still got to fix it. hahahaha

SO.

I'm going to get a quote for the work, write to morethan with a copy of the estimate and ask them to come out to me and assess it and then pay my garage to do the work.

if I cant do that ill simply whack on the bumper in the garage and fit the spare headlight cluster I have and get a bootlid off a breaker from here!

I don't get any of that.  None of it makes sense.  Why would you be buying a car from the repair centre?  It's your f'ing car.

That aside, 30% of 300 is not 300  ;D

That aside, seems like you need to grow a set and tell the insurance company how it's going to be!  ::)

Failing that, get YOUR insurance company to deal with them.

I cant imagine the people who took your car have any legal right whatsoever to demand 30% of your payout.That must bordering on demanding money with menaces ffs !

Webby, how come you aren't sat in a nice shiny new Hire Car paid for by the third party insurers?  :(

After a small amount of digging, the general information I can find is the buy-back would be 10% of the car's value (or I should say 10% of the offer made by the Insurance Company) The value and offer should tally-ish.

Cat D write-off, like yours would be (I erroneously said Cat C above) (if it is indeed written off) doesn't need a VIC test or anything, just stick a bumper and tail-light in and drive it away.

On my first point, push push push for a hire car from them.... That's a costly thing to them and you are more likely to have a speedy conclusion to this mess if they are paying £30 a day for you to spend around in a lovely Peugeot 107  ;D

My car was repair estimated at my address and written off , i was paid full amount and next day a low loader pulled up . Asking what scrappy he was taking it he said ha ha oh no , this one is going in for repair like the othe 4 on the trailer  ::)

Big business in write offs ..
