yeah sorry made mistake with the 30% of £300  ::) ;D

in all honesty I cant be arsed with the worry of them having it at theirs. and I also know that even if I grew a set and argued with them they wouldn't budge with getting my own person/company in. its their way or the highway.

however ill still try in writing to get some dosh out of them. in the mean time though ill fix it myself

Webs, at the end of the day its their responsibility legally to put your car back into the condition it was prior to their client banging into it - that's the law and fact.  You need to stand your ground, tell them politely to feck off and pay up for repairs.  Write as I said and if they don't respond positively, get it done and send them the bill.  You will win if it goes to County Court - the judges there always side with the "small guy" against the big, particularly insurance companies - been there done it :y

Agreed :y

They know their responsibilities, which is precisely why they are trying to avoid them ::)

Now You also know them, so don't take any nonsense. If they still insist on taking the pish, ring your insurers and get them to put Morethan straight.

If it comes to it I can recommend a decent accident management company :y

Said this so many times on here in the past, if you've had a ding and it 99.9% not your fault, dont bother going through your or there Insurance, straight on the phone to an Independent Insurance Assessor, He knows how to deal with the 3rd party Insurers, will get you a better deal, more agro money, loss of earning etc, and the Car will remain your property until fixed or scrapped, and despite what the 3rd Party Insurance co says you dont need to mention it to your own Insurance Co, unless of course it ends up as a Cat * something and thats only informative info to remain insured with the same car.

Webby, how come you aren't sat in a nice shiny new Hire Car paid for by the third party insurers?  :(

After a small amount of digging, the general information I can find is the buy-back would be 10% of the car's value (or I should say 10% of the offer made by the Insurance Company) The value and offer should tally-ish.

Cat D write-off, like yours would be (I erroneously said Cat C above) (if it is indeed written off) doesn't need a VIC test or anything, just stick a bumper and tail-light in and drive it away.

On my first point, push push push for a hire car from them.... That's a costly thing to them and you are more likely to have a speedy conclusion to this mess if they are paying £30 a day for you to spend around in a lovely Peugeot 107  ;D

Belatedly sorry to hear of this sad news Webby.  I do hope you sort everything out to YOUR satisfaction.  As others have said, take no nonsense; it was not your fault so you must not lose out in any way. BM is right - you should by now have a good quality hire car at your disposal.

Over the last 3 years I have had two "non-fault" accidents.  On both occasions I had a EuroCar Mercedes E class, a 320, at my disposal for weeks whilst they decided what to do with my cars - one was a write off, the other they tried to write off but I refused to allow them to do so - and  both times the third parties insurance had to cover the hire car costs whilst I sorted out a replacement (which cost more than the w/o car was actually worth) that I insisted had to be at least as good as my existing car, and in the other case until another repair centre, not the one that tried to write it off, made the car good.

In both cases I also received all costs incurred, and my excess was completely covered by the insurance companies agreeing on a direct payment from one to another without me being involved.

This was the write off:

far worse than yours which should be repairable

and this one they tried to write off but finally agreed to repair:

Cannot see the damage?  No, there is just some light damage to the paintwork, but the buggers tried to write it off, and I drove to the car repair firm immediately following their phone call and grabbed my car back. Proves what others have said is right!

Everything should be to your satisfaction!

There's a large amount of good solid advice to be had here, don't back away from a bit of a tear up with the insurers,it seems that trying to shaft an innocent member of the public going about their business is part of the game to absolve themselves of the responsibility that a lot of large companies do by hiding behind terms and conditions and small print which in turn is used to move the goal posts and frustrate us...the lowlife parasites >:( Go get em!! :y

I'm going out on a limb here - I think there is more to Webbys story than has already been told.

If I'm wrong, I'll apologise sincerely.

Webby, did you reverse into something?  It's ok, we wont shout at you!  ::)
