If I purchase a car from a private seller, and the car is taxed and insured and has an MOT.....can I drive it home under this scenario.....

 At 1200pm I go to pick up the car, I pay the owner the money, and get a receipt  signed and dated with the time 1500pm. I drive home

In effect, as I see it...the present owner will be 'lending' me his car for three hours. As it is insured, I can drive it on my insurance (3rd party) to home.
At 1500pm the car becomes mine...he will cancel insurance, and tax, and I will then tax or sorn it, and get my own policy for the car,

Would this be legal.

I dont know if legal but i picked my car up from oxford and drive it home. it was still taxed from previous owner. i taxed it the following day and started the insursance on that day aswell

It's not "in spirit" with the law but I'm sure Mr loophole would be more than satisfied. I'd do it

I thought about this a while ago. I would definitely drive it home......but......if you were involved in an accident, I'm sure the insurance company would try to wriggle out of paying up...iif there was any way they could find out you hadn't taxed it.

I see your point Steve...but what if I got a short term cover, in my name, fully comp, for the car...then surely I would be covered.

If you have 3rd party "any vehicle" cover it applies only to vehicles you don't own, so I'd say you're not insured form the point the deal is done. The seller's policy is probably not valid from that point on either, so the vehicle itself is not insured, although it might take a while for the database to catch up. You might be able to chance it, backdate the transaction, etc. but given the possible consequences, I wouldn't.

Let's face it, if someone bought a car from you and something terrible happened after they drove it away, you'd deny all responsibility and claim they'd bought the car and driven away, responsible for their own insurance.

If you ask your insurers they'll often overlap cover for a month on your old and new cars when swapping.

Better to buy a 24Hr cover policy.....belt and braces   although when I bought a car from Elite Pete he left the tax on the car and I returned it back to him by post and also he let the insurance run to give me time to get the car back from Chester.So as Kevin and Sir Tigger say a bit iffy.

Even a 24hr policy would be illegal if you'd purchased the car and not taxed it.

We are starting to get picky now. As I said earlier, I would drive it home. But I'm a rebel.

Terbs, insurance is a five minute phonecall once the deal is done. Similarly, tax can be done that instant online for the direct debit thing, takes a whole three minutes.

The DVLA already know that the car is MoTd, and they ignore the Insurance requirement for taxing purposes as it can take a week for it to show.

But no excuse for not taxing or insuring nowadays, provided Mot is current

Ah...never knew that...so insurance does not count now then when you tax it.

I thought you had to phone them to tax the vehicle when you bought it. So you are saying you can fill in the details of yourself online and pay by DD or credit card ?? And then send away the V5 and the little change of ownership slip.

I agree Mark....I was not aware it could all be done online when buying another car....Insurance wise, I know my brokers number off by heart.
Does the owner have to claim back his tax before the new owner applies, or does it not matter.
