current law in england is that you can't hunt a fox with dogs, one two or a pack. hence the claim that fox hunting has been banned. an exemption is that you can flush a fox out of a hole or cover then shoot it, provided you only use 2 dogs and that as soon as the fox is out, you shoot it. the dogs must not continue to pursue the fox once it has left cover. if you use more than 2 dogs the fox is likely to be ripped apart before it can be shot, or chased by a pack of dogs (you could control 2 dogs but how to control a pack), which is pretty well fox hunting made legal again.
the Protection of Wild Mammals (Scotland) Act 2002 talks about allowing 'a dog' 'under control' to flush out a fox. one clause in it redefines 'a dog' - "references to hunting with, or the use of, “a dog” are to be interpreted as also applying to hunting with, or (as the case may be) the use of, two or more dogs.". another clause defines 'under control' as "a dog is “under control”
if—
(a)the person responsible for the dog is able to direct the dog’s activity by physical contact or verbal or audible command; or
(b)the dog is carrying out a series of actions appropriate to the activity undertaken, having been trained to do so. "
a cynic must see both these additions to the scottish act as there to allow fox hunting with dogs, which supposedly the act abolished. bit academic as no one seems to enforce the act in scotland anyway.
