Compensation
« on: 23 September 2008, 19:38:12 »

My phone line has just had a permanent fix today 55 days after the line first came down. It required just one new pole.

After 27 days the little people repaired the line as B.T refused to do a simple 10 minute repair on the grounds of health and safety.

What do you think I can claim in compensation?

So far I think it is this -

2 months of line rental at £10 a month.
2 months of internet charges at £15 a month.
2 months of Credit Card terminal rental at £33 a month.
Mobile telephone calls of approximately £250, but I do not have all the receipts. Would that be a problem?
Call divert wrongly charged to us £60.
Charge for disruption to life for 55 days - would I be entitled to anything for this?

What do you think to be fair and reasonable compensation, bearing in mind we did not have a proper phone line for 55 days, and were without a telephone entirely  for 27 of those days. ???

Thanks
Dusty:-* :-* :-* :-*

I know you were wound up about this, but I personally would take the philosophical view on it and chalk it down to experience.

Just in case BT have little people of their own.  :)

It is clearly unnaceptable that BT left you without any phone whatsoever for 27 days, and then took a further 28 days to effect a permanent repair.

You should certainly get your line rental back and your internet charges back, as you were unable to use these.

The same goes for the credit card machine which needs the telephone line to function.

Call divert should be reimbursed, not sure where you stand on your mobile phone charges without proof that you spent the money.

As for compensation for inconvenience, that would depend on who is looking at the claim. Some may look at it more favourably than others.

Anyway you have nothing to lose by putting in a claim and seeing what happens. :y :y

It is not that unusual for BT to give such poor service to the general public........sadly

To a degree I think optimist60 is right, but as you have a card machine and run a business then can you prove loss of earnings. if so then make a claim.

Lets face it, if the boot were on the other foot BT would chase you for thier loses. :-/

Check your phonebook, which explains it.

Business Lines - actual financial loss, capped though.

Personal Lines - a set amount per day.

They will pay for cost of incoming diversion. They won't pay mobile charges. They are unlikely to refund ISP charges - thats down to ISP, and seeing as its an IP Stream solution, won't carry any SLA anyway, so little chance.

Ask for as much as you can justify (plus a bit). If its a large amount, they will hopefully take you seriously, and if you leave enough room, you can always give in a little bit, so they think they have won a bit, when in actual fact you have added a little extra on at the beginning to cover it.  :y

Best of luck,

Ken
