Police entrapment for speeding.
« on: 17 January 2009, 21:33:23 »

Just wandering if anyone else has had this happen to them. Iwas driving home about 9pm on a dual carriageway with hardly any other traffic about and good visibility/road conditions, doing about 80. Got to a roundabout and turned onto the single carriageway doing 60 when I noticed this pair of headlights come roaring up behind me, getting right up my ar*e. Now be honest, how many of you would think either A) Im just going to sit at the speed limit and you can just wait pal orB) think f*cking boy racers, and floor it! Unfortunatly I decided on the latter. I had the chipped Prelude at the time so the Vtec cut in and I pulled away and hit 90 before the undercover cop car behind me put his blue lights on. This has happened to 2 other people I know of who were also driving at the speed limit before the (unidentified ) unmarked traffic police car got up their backsides and they foolishly chose the same option as me. Seems a bit of a case for entrapment?.
Must say, however , that in the (thankfully) few cases where I have been caught by a traffic cop theyve been nothing but fair and I have been let off in the past despite "speeding" because the officers "could not say " that I had been "driving unsafely" and theyve used their discretion in matching my driving to the conditions.

in all fairness,

a) you shouldnt have been doing 80 (prob what got their attention)
b) when they came roaring up behind you, you should have let them past (if safe to do so) or kept to the speed limit. boy racer or not in their eyes there is no excuse for "flooring it"

Glad tho that they gave you a caution and didnt charge you. but there are others out there that floor it cos they have something to hide.

Years ago when i was younger & had a porsche,  i stopped at a set of road works lights on a street in peckham - car pulls up beside me, but a couple feet short of being level with me and revving it.
lights change -  so i floored it  to get a head start but took the foot off when he hit the blues & twos, over took me and sped off into the distance  :o
mind you when i had a carlton when ever i had to travel for work and took a workmate we always wore white shirts and dark ties  8-) - amazing what happens when a car in front sees 2 blokes in shirts & ties  in an dark blue carlton :y

Tricky one that. Tempting to sink the boot & embarrass the tailgater if you've got the poke ( the MV6 & 328i usually can) but if it's a patrol car you're at risk of a nicking.
Morally yes it's entrapment. Legally you should'nt take the bait so would be in the wrong. Personally if i was in a car i did'nt love i'd anchor up "because a fox ran out in the road". Big ins. claim. 8-)

Simple observations....

You were initially speeding - 80 you say???

Car closes up your erse to see if you are either a) going to floor it again or b) behave....

Ultimately, you got a quiet word.  Seems like a result??

What i do these days is slooow down - cause a car that close is going to hit my pride and joy if i have to stop- so i slow to an acceptable speed for  the distance between cars.
slowest i've been around town is 14MPH :y NOBODY intimidates me with a vehicle - unless their are  7.5 Tonners and above

No doubt that it was because I was doing 80 instead of 70 that they chose to follow me but I still think its a pretty intimidating tactic to see if youll then further break the limit. As an afternote, whilst the mig was off the road having the oil cooler fixed recently I borrowed the wifes toyota emina bus. Same stretch of road, in the right hand lane coming up to the roundabout to turn right and sticking religiously to 70(!!). Anyhow this car comes roaring up behind me and starts flashing me. Not wanting to be caught again (a tad unlikely in the bus i admit), I continue at 70. If hes in that much of a hurry then there was plenty of room/time to undertake me before the roundabout as there is no other traffic about. Anyway, he flashes me again and I check to see if there are any warning lights on etc, nope, and its only when he flashes me for the third time that he puts his blue lights on . Great, unmarked car, he must be on a shout I think as I change lanes to let him past. Just as I pull back into the right lane to be in the right lane to turn at the roundabout this vectra comes storming up to me, undertaking me ,then turning right down the same single carriageway. Must be another cop car I think. About 1/4 mile down the single carriageway there is the vectra pulled over by the unmarked traffic car!Go figure! :-/.

Re-read the highway code.  Something like return to the left lane after overtaking.  You say that there was ample space for the police to undertake.  Ergo, ample space for you to get into the correct lane to proceede sfaley...

Sorry, one of my pet hates.  Lane hoggers in the wrong lane wanting to run right on the roundabout at the end of a dual several lightyears ahead of them.....

Might be seen as lane hogging but this was still well after the "get in lane " sign so I was in the correct lane and doing 70 in a 70
limit. Cant win here can I?.

I used to work for Securicor. At first glance the uniform was very similar to Plod. My car was a white Carlton.  Pain in the ar$e driving to and from work.  If the driver in front noticed the car and the dark blue uniform, it was a case of 1mph below the speed limit for the rest of the journey.
Surprising how often a left hand would be seen fumbling around between the drivers right shoulder and the door pillar in search of the seat belt.  ;D
