advice needed

i ordered some shocks (bilstein b4s) from autec.de and after 60 days they still haven't arrived they rung me before christmas to say the courier had lost them and then after countlless emails they wrote to me on the 3rd of jan to say bilstein are sending them to them and then they should be coming to me the last email i sent them on friday was give me a date when they should arrive and they wrote back they have the rears in stock and "as we discussed" (yeah right) the other pair are coming direct from bilstein so i wrote him an email saying nothing was discussed and i am now afraid that he is waiting on china!! to deliver these "shocks" and now i have heard nothing, it's 220 euro haniging in the air if anyone has any ideas on what my next move should be please let me know these were from ebay but not over paypal what can i do???? this is just a pita as all i want is to get the mig sorted and put it on the road, many thanks rich.

Ring the bank, cancel the transaction and get them from balance motor sport instead?

15/11 ordred 16/11 "sent" 27/11 email where are they? 1/12 phone call lost in transt promised they will be sent before new year! at this point there was so much snow not too bothered 27/12 email from them can't get hold of bilstein 3/01 bilstein will deliver to us and delivery is imminent now waiting two emails later they are saying bilstein should be sending direct to me?? what would you do??

Bank will either help or not, nout to loose.

Iirc you have to dispute the transaction, if debit card payment they send a form, you fill it in, return it blah blah, it's not a quick process, but once underway I believe they will return the money.

If credit card payment its quicker, and guarantees are better.

Fact is you've not received goods and the seller won't be able to prove otherwise.

Even if the goods arive in the mean time, ime the seller will then contact you for payment at a later date. But then your on even ground and take it from there.

it's been a while since I had agro such as yours, but that was the deal at the time iirc. Might be different now, but worth a phone call.

Chris is right, you should pursue this through the bank.
I would also contact ebay and raise a dispute aginst the seller, although, that may be too late now.
I fail to understand why anyone would buy from ebay and not use Paypal.

If it's a credit card the credit card company are jointly liable and, if you have tried for a reasonable time (I've been told 30 days + in the past) to resolve the issue with the seller, you can move onto the credit card company and demand a refund.

The only flies in the ointment I can see is that you're in Austria (but perhaps equivalent legislation exists there) and, if you paid through an intermediary such as Paypal, your credit card company might say that their responsibility ended with paying paypal and you need to use their dispute resolution.

Google for section 75 of the consumer credit act.

In the past my credit card have promised to investigate then done nothing, but after receiving a letter pointing out the provisions of section 75 they've just refunded the money.

If this transaction was made entirely within the boundaries of Austria, I would think local consumer legislation (including banking regulations) would need to be used to address any grievance.

As you purchased these items through eBay but didn't use PayPal the matter is slightly more complicated, more so as some considerable time has elapsed since the purchase was made before raising any dispute with eBay.

My first port of call would be to contact the supplier and ask for a refund in the absence of the items being immediately available.

Should they refuse I would raise a dispute with eBay (or try to at least).  I would be inclined to do all the messaging through their service and keep copies of all transactions with the supplier relevant to the issue.

If that is unsuccessful and depending on where your credit card is issued/ bank located, an approach for advice to either may help you get things sorted - although again this may be dependent on local legislation.

yes i agree don't buy off ebay without paypal but at the time my account was in limbo with i.d e.t.c! anyway i'm off to the bank now to see what can be done many thanks, Rich.

My Spanish bank very promptly refunded 100 euros that a "Frenchie" stole from me. However they still haven't sent me my new bank card yet(4 weeks but that is Spanish banks for you)

I got my Bilsteins B4's from Balance Motorsport a couple of weeks back. Excellent trackable service with signed for receipt. If you have to buy more I can recommend them.

thanks for the advice chaps, today my rear shockers turned up and the fronts are suppose to be coming from bilstein direct, i called the guy today and he said he would chase them but as usual i haven't heard back! anyway halfway there looks like it's a waiting game, i have reported this company to ebay as they are still advertising these shocks even though they don't stock them, i also talked to the bank but they couldn't help me so i geuss the next step would have been a lawyers involvement but anyway things are looking up and fingers crossed the front ones will arrive this week, thanks again for the advice and i will certainly never buy off ebay again without my paypal account!
