yep, that's a viper kit alright.

Basically a cone filter encased in a carbon fibre housing so as to stop it from being affected by the heat from the engine bay, the cold air feed aiding this job by getting air that is outside of the engine bay.

A lot of money but worth it just for the issues its resolves

I had one on a Mk2 cav Convertible with a C2.5XE fitted, along with 3.0 cams, modded throttle body, tubular manifold and a 4 bar FPR it was kicking out 202bhp, you should have seen peoples faces when that thing took off

Yes it is mine & the intake may not be to everybody's taste but its grown on me. I was going to change it but was unable to find anything that didnt restrict airflow too much.
As for the positioning it was the only place the pipe would fit and ive never had any problems with sucking up water as i tend to avoid rivers  
i did have to put some mesh inside as i didnt want to suck the odd furry animal.
