Used car dealer speaking with forked tongue
« on: 12 September 2009, 19:55:21 »

Hi all,
I've just discovered that when I recently bought my Omega, the dealer was not as straight with me as he should have been. A few checks and 'phone calls have allowed me to discover that the cam belt & tensioner, although within mileage life, is actually nine months overdue in time terms  :-?.... In addition, there is some wear to the front suspension mounts that he knew about but did not bother to tell me  >:(. There have been some creative writings in the service book - so whilst the car has a pretty good overall service history which I have verified, it would appear that during the last year, all is not what it seems. The dealer is some distance away, and has been evasive - I've now got trading standards involved, who reckon I've got a good case under the sale of goods act.
Needless to say, I'm displeased  >:( >:( >:(

What winds me up even more is that I really like the car!

It may just be a case of negotiating compensation or getting the work done. To be honest if they are dodgy I would not let them arrange to do the work as you will not know the quality of what parts are being fitted. One plus is it may get some bad publicity for the garage concerned as well

Had the same problem a few years back,Trading standards just warned the garage as he told them he had only passed the info he was told.In the end i had to take the dealer to court to get my monies back.

Once bought an astra estate (for work) that had been clocked by the dealer i got it off .
Thing is the dealer had put a disclaimer sticker over the clocks licence to clock cars those stickers.
Never will i go to him again however i was left with a car that trading standards could do nothing about even though they knew the dealer was dodgy plus i had the thing were if i sold it on or traded it in i would be the one knowingly passing on a clocked car unless i cared to mention it.

Absolutely no offence intended mate, but unfortunately I don't think you'll have a huge amount of luck with the suspension mount wear.

As long as the car had an MOT, it will just be considered wear and tear, and won't really go anywhere I don't think, especially if its not given you any problems in the time you've had the car so far.

On the cambelt side of things, however - you may have a little more luck. At the end of the day, if the car establishement gave you duff info about when the belt was due, you may have some recourse, within reason - because that would be a misrepresentation.

Either way, good luck, and please keep us posted  :y

Absolutely right - if you can't trust them to start with, Leopards & spots and all that sort of thing.....
On one of the rare occasions they engaged in conversation, the guy was on about how it only (HIS words, not mine) 'costs about £70 to change the belt on a V6, and you don't need a locking kit, garages just use drill bits to keep the cogs still' - that says it all!!!!!  :-?
Sorting by a reputable mechanic (thanks to the OOF  :y) is the only option, then I'll let the law do its bit......

Hi all,

Know it's been a long time since I started this thread - but I'm happy to say at last, I've managed to get the money back for the cam belt & tensioner work from the dealer! (along with court costs) -  It's taken a long time, and commencement of action via the small claims court, but they finally coughed up!  :y
Thanks for your supportive comments - it just shows the system can work!  :y

Great result!
You did just what I would have, and have done in the past.
It is really surprising when you put it to the Small Claims Court, after ensuring that you are in the right of course, and they receive the summons how quickly they will come to their senses. It shows how silly the buggers are when it then costs them even more by the addition of costs.
Its best of all though when they do not pay up in time and their Credit Record is blackened as a result of the 28 day rule.
