Does anyone know the correct procedure for selling a Cat c write off (the buyer is aware)  It hasnt been vic checked yet.What would my resposibilty be as a seller? Is it a simple case of filling out the reg document and sending it off as usual. Once ive filled out and sent the log book to dvla can there be any comebacks to me?

The only thing I would suggest you do, is both YOU and the BUYER sign a receipt which clearly states the car is a Cat C.

Thanks for the reply I will do that . What would happen if theyre lying about who they are or am i just being paranoid .Its the fist time Ive been in this situation.

Depends on the level of your paranoia I suppose.  You could ask to see their drivers license to confirm their identity?  As far as the DVLA are concerned, once you have a signature of transfer on the V5, the car is no longer your responsability.

I've not bought or sold thousands of cars, but I've had a fair dabble in the market, and I've never had trouble after selling a car.  Just be sure YOU are the one who sends the V5 back to the DVLA.

 Im just looking now at the downladable bills of sale on the internet, Im just worried that the guy whos buying it is just going to drive round and not do the ness vosa check, The car had about 6 mths mot on it and the damage is a dent to the back door - Would you know if the MOT is now void on it or not

Cat C, I believe the MOT doesnt stand until a VIC test has been carried out by a 'proper' VOSA place.

Dont worry about anything fancy as a 'receipt'.  Just scribble something on paper, but make sure it includes the fact the car is Cat C and not currently road legal until the relevant test has been carried out. 

I presume you dont know this buyer, so was the car advertised?  If so, keep a copy of the advert which (as you have said) describes the car as a Cat C.

I appreciate that Cat D is a different matter with regards to the MOT.

 So do I give the buyer the valid mot  I done the goverment mot check online and it says its still valid also what part of the log book do he have sorry lads

Normal sale, but be aware as mentioned no dvla documents will be issued until vic check complete. Mot as normal rules (but insurer will insist on mot after repairs ime)

If i own a car that was mot'd and taxed but gets bumped, written off and returned to me as part of the insurance settlement it remains taxed and mot'd until they expire and can be retaxed  mot'd etc until the ownership changes as I understand it. The Vic is purely to prevent stolen identical cars being passed off as repaired and has near bugger all to do with roadworthiness. The new keeper supplement is all you need to give along with a receipt showing you stated it was a cat C needing a VIC.

DVLA only "advise you to get a new MOT" but you don't need to unless you want to waste £40

Mot does indeed remain valid, but, your insurer will cancel cover on the car while its classed as a write off. To re start cover they will only do so once the vehichle has passed another normal mot inspection. Only then will they recommence cover.

So the original mot is indeed valid. But effectively useless to anyone, without insurance.

It will also state on the bottom of your new V5 that the car was a write off but not in them words. I bought a vectra that was a cat c all i did was take it for a VIC check so i could get a new V5 then a mate of mine bought it of mine since then sold it to someone else. I also asked about the mot being valid and vosa said it would be but some insurers are a bit funny about luckily mine had 11 months left on it and my insurance was ok with that.

not true only when you recive letter from them are you no longer the legal owner.up to that point you must prove you where not driving the car
