House registration.

A solicitor has informed my ninety year old mother that the house she owns and has lived in for 25 years is not registered (presumably with the land registry)

He wants £650 plus £185 + VAT for each extra hour if he encounters any unforeseen difficulties to legally register the property. Is he a crook?........Is it a legal requirement that your property must be registered?

The solicitor informs her that it will cost far more to register the house after her death.

Any ideas chaps?

I have no idea, I'm sure somebody will, but a first port of call if it were me would be the Land Registry office ???

You should get a quote from a couple of solicitors - with your mother being 90 maybe age concern would help to get her dome help.

I would contact the land registry, it should not cost that much, I can check with a friend who works for them if you like

I'd tell him to take his face for a shiiiiit. Do it yourself. How do you know he's even genuine, and not a scummy bastard preying on a vulnerable old woman.

Would you not have heard from the Land Registry by now if it wasn't registered? Even if it's not, it'll be a simple case of proving her occupation/ownership of the property which can't be hard, then simple documentation and a small admin fee.

Try and lead this guy on and get trading standards and police involved as it's blatantly a ripoff.

Just think, when you buy a house, the house registration part of the conveyancing fee is nowhere near that. Rip off.

Check the house sale docs, if she has them after 25 yrs. There should be the Land Registry doc in there. Or for a about £4 you can do it on their website for any property.

Only houses that have been sold since about 1990 will be registered with the Land Registry, so the original title deeds are the proof of ownership.  It may be, that it's easier to sort out someones affairs after departure, if their house is registered at the Land Registry.  However I cannot believe that you need a soliciter to register, as Geoff said a few forms and an admin fee......  ;)

We bought our house in 1978. In October 2003 the Land Registry Act came into force and "title deeds" lost all legal status. The Land Registry, in conjunction with the Building Society (mortgage holder) automatically transferred the details o the Title Information Document (TID) and sent me a copy.

AFAIK this should have happened to all property, but may have been missed if no mortgage was outstanding as the paperwork would have had to be done by the owner, if a mortgage was held then the building society did it in order to register the "charge" they held against the property.

That information is taken from the documents sent to me by both the BS and the Land Registry, admittedly some 7 years ago !!!!!

25% of land in the UK is not regitsered .. but you can find out if yours is, and how to register it here ...

It took me les than 5 minutes to check my property, which is listed, and it would cost me £4 for a copy of the Title Information !!!!!!!!

If you look at the bottom of the link there is a 25% reduction for DIY registration !!!!! So it can be done .. just needs an e-mail sending it would seem :)

Gets easier the more I dig ...  on-line calculator tells you the fees  ..

I don't think it's a legal requirement to have your house registered at the Land Registry.  When the house is sold it will then be registered in the name of the new owners.  :)

The problem might be that a potential buyers solicitors would not be able to show that the seller has good title to the property, causing problems with a sale of the house.

I would be inclined to sort it out now to avoid a potential spanner in the works dealing with her estate when she passes away. That will already be a difficult time without perhaps having hassles selling her house. I'm no expert, though.
