Surely it's an assumption until you know the cold hard facts from the people involved, not word of mouth 
The OP was fully involved with the injured party in their house and the foreman stating "no 999" in front of them. I have no reason to doubt the OP's account of what happened as he was involved.

For a start neither of us were there so we are both assuming, correct?
From what I have read, and i'm only assuming because I wasn't there. The op got home from doing errands and there was a young man in the kitchen. It sound to me like he had told the op's other half what had happened and the op other half had not seen it.
So what you are saying Pete is that no matter what members post on here as fact, that they have witnessed, we should not believe them until it is upheld in a court of law?
You and I both know that will never be right and proper and for most of us in life we have to at least give some respect to the people claiming to be witnesses and believe them in the first instance until proved untruthful. If not, then I agree with TB that this whole "General Chat" section should be closed down as a dis-credited medium where it will always be open for one's persons opinion to be pitted against another, with constant arguing about the validity of the information being discussed.
This thread, like so many, is purely what one person believes to be the case, no more, no less and on a car forum we can never ascertain the legalities of it all. In this case we can only take what 78bex has stated that HE was there, and even spoke to the foreman, but obviously Pete you have read something different.
