Seller has made contact. Car is still available but logbook has been lost.

I replied saying I will still take it providing he knocks £25 off to cover the replacement v5.

He has declined that, because the car was cheap in the first place.

I'm between a rock and hard place. Yes it's only £25 and I could suck that up. But equally I bid the max I was prepared to pay, so shouldn't now have to pay more.

Thoughts? I know ultimately it depends how badly I want it. I don't want to back out of the deal and risk negative feedback. I equally don't want to lose an unexpected £25 :y

James. if it really is a good car (and you know your Omegas), you will enjoym the benefits of the car long after the memory of the £25 has faded!
Also, could you not negotiate on the £25?

£25.00 not a fortune , five gallons of fuel if you look at it that way if it is what you really want & you've got it cheap bite the bullet & get it.

Is all else fails, that would enable you to open a dispute with Ebay.
However, if he HAD declared that it was missing, he can say that you know what you were letting yourself in for.

"You do not have to pay a fee in the following circumstances:
• If you are the new keeper and the previous keeper failed to tell us
about the change, you must have the ‘New keeper’s details’ section
(V5C/2) from the V5C and send it to us with this application form."


Without the V5 how does James get the new owner bit .. V5C/2 ?? the little green bit if memory serves ??    :(

He doesn't,thats the problem as it can't be taxed without the ref number on the V5/V5C

hyhe cant give you negative feedback if he is selling something that is not as advertised.  If you want it, eat humble and buy it. But dont afraid of a negative strike as it will go against him if you file a case.

I think that unless price can be re-negotiayed to take V5 into account then you'll have to stand the cost of one.Is the car taxed or on sorn?If on sorn I believe it can be taxed by using ref number on sorn paperwork?As has been said there could indeed be issues regarding legality of ownership-or have you had it H.P.I.'d? I've bought 4 cars from e-bay[including the present Elite] and have every one of them H.P.I.'d prior to placing a bid on them,no matter how cheap they were.

In which case the current owner should accept responsibility. Why should you be out of pocket, James?

Walk away and bid again when he puts it back on ebay, he'll probably attract less bids second time round as everyone else that was interested will assume the car is shite and the previous winning bidder didn't complete on the sale!   ;)

Also he should declare the lack of V5 on his next listing!  ::)  Although lets not hold our breath on that point!!  :-X  ;D
