coming home last night had a vectra pull out on me and suddenly stop with no indication and one brakelight!!
slammed on the anchors but clipped his back bumper knocking it off its bracket and marking the bumper,

couldnt speak english and got out the car and approached the car very violently, Luckily i think that as i was alot bigger than him this put him off,
just kept saying INSURANCE INSURANCE

ended up going to his house round the corner and his 12 year old translating for him, taking pictures etc, i said look its only a bracket i will go to vauxhall buy u another and fit it now! " no no no insurance insurance" so we swapped details,

i hit him about 15mph, his 3 year old was in the back with no seatbelt on! stnading on the back seat!!!

so my insurance company basically said as i went into the BACK of him its technically my fault!!

so im gonna loose 1-2 years no claims for a ten quid bracket!

What a jip!

You should have taken a picture of his child on the rear seat and kept saying Police.  Police and watch him sqirm.  I bet he would have let you fix it then.

Bad luck matey.  Probably stoped quickly coz of the young un in the first place.  :-/

didnt sleep last night just thinking what if i was doing 30!! (the speed limit!) that kiddie would of gone flying! i would of, if i had someone in my car with me or rang the police as i cant remember seeing a child seat,

spoke to a traffic copper last night he said most of them have foreign insurance and wont be valid here or no mot!!

As long as you were not over the speed limit.  What concerns me here is.  Has the guy done this on purpose for the sake of an insurance claim, it seems to be the latest scam.  I really hope this is not the case due to having the child on boad.  But FFS why didnt the guy have his child secure, it's the Law and he was breaking it.  Make sure your insurance company is aware of the child standing on the back seat and tell them you didnt see a childs seat.

The law is there for a reason, regardless of what country they are from.

Dispute it and give the full facts to yor insurance company.....I suspect they may go knock for knock on this one.

Best way to try to keep ahead of the game now is to remember......


Camera

Police

Witnesses

Take photographs at the scene, contact the police, in this case alleging careless driving, and seek witnesses to the event.

Seems now to be sensible to collect as much evidence at the scene as possible as the dispute will normally start after the event and without some form of firm evidence, will always degenerate into a they say/I say exchange.

AFAIK he cannot insist on your insurance company paying.  If you want to pay for his repairs direct then he cannot alter that.
Down side is it will be on the basis of some quote he gets from somewhere since you can't insist on doing the work yourself.

It is pretty difficult to avoid responsibility for rear-ending someone but you should have a case if he pulled out without warning, leaving you insufficient room to stop.

I am currently having to go to small claims court over a gobby bird who rear-ended my Omega.

Im a architect assistant so i have measured the distance from the roundabout with lasers (to be accurate) i was coming off, taken photos of the junction he just come out of well it wasnt a junction was like a driveway!
and i have a number of a guy who saw it, i phoned him and basically his response was " yeah mate sure no bother better get these foreign monkeys out our country" thought .... rriigghht racist but oh well!

i have given the number plate to a "friend" who is gonna do some checks on it for me,

though i see why my dad had omegas when we was kids! i hardly felt a thing!!! and not a mark on it , i have photo'd that showing to the insurance company that i couldnt of hit him hard

Although I downed my cover to TPFT I did go for the Legal Protection so a friendly bunch of solicitors is handling it for me.

I would recommend Legal Protection in this current climate.
