God glad i never had any of that, My circumstances must have been differant as i had none of that my bankruptcy was due to me being ill and unable to meet mortgage/car loans etc, you had it after i had lots before we wouldnt even go out and leave the kids alone for fear of debt collectors.
I had some fantastic advise from the local CAB and they advised me to declare myself bankrupt and i know it sounds bad told me to go to the hole in the wall with my credit card to get the £500 that you need,As i say mine was differant as i was PAYE Employed by british gas before, But on my papers my income was only disability benefits as thats all i can now do,
These days its not as bad i even now have credit cards, bank accounts phone contracts etc ok not sure about a motgage but hey who would give a disabled bloke on benefits a mortgage anyway.
The only stigma i found is friends or so i thought don't want to talk any more Gutted !!!
But as you can read been through it and bloody glad i did,

I know what you mean  :y
After spending 4 ish years, trying to dig myself out of a bloody deep hole. Everytime you think your getting somewhere, some tinker doesn't pay you on time or more's the case, you don't get payed full stop  :'( :'(
I remember sitting in a cafe with a mate in the trade who had just being through it all himself.
I don't mind admiting that I was totally out of it. Shakeing and blubing like a kid and on the verge of suffering a total breakdown until he sat me down asked me one question .................... What have you got that they can take ?
Once I got my head round that the rest was easy  ;D
I'm ex RAF so the Royal British Legion sat me down and sorted all the paperwork out for me in such a way that made it pretty watertight  :y
They even gave me a cheque to pay for it  :y

Great feeling when your not scared to answer the phone or front door anymore  :)

Hopefully thats good news for you Steve, their so busy at the moment, their trying to get people of the system to keep the work load down.

I must point out to you though that they have 15 year window to come back to you on if it comes to light that your doing really well in cash flow terms or you aquire substantial assets in that time.

Be warned, keep things close to your chest.

Chris. :y

How far back was all this Chris ?
I'm getting totaly different messages on this  :-\

Basicly, i've been told that they can only make a claim on pentions ect if your had been paying in at the time of your bankruptcy  :-\

I've been signing on since july 09.
Initially, claiming that I was working 16 hour or less so I got my stamp payed  ;)

It was only on the run up to bankruptcy that I totally ceased working  :-X :-X

When I finally got the judge to sign the order, my statement of affairs basicly said that I had ...........

A car worth about 600 quid
My tools
And my gonads  ;D ;D

I was living with swmbo.
The house is a council house in her name. ( I'm not even on the rent book )
We are not married so anything in the house other then my tools was her's  :y
I was upto date with HMRC, even though I didn't even pay any tax for the last 2 years.

I was warned by the reciever at the time that if I came into any money in my name during the next 12 months, I had to inform them and the would "take a slice"  :'(
Once the 12 months or less had run its corse, that was it  :y
Whatever I get is mine  :y
It would be interesting to know were I stand in the future because i'm down for half of my parents estate (when there brown bread) and they are not getting any younger  :(

Not sure Steve, although on the House asset side fairly sure there was a recent change, that meant they had to have an interest in the property within a 7 year period from the time a bankruptcy, or something similar, will need to check on that one, they way to be sure though is get your Parents to state in their will that any assets left to you are on the basis that you are free from any Bankruptcy liabilities.

As for the other questions, I do rub shoulders in my local with a Solicitor who only deals with insolvency, if you wish Steve, drop me a PM with any questionsyou may have and I'll get some free answers for you.

Right, me and swmbo poped in to see the reciever yesterday.
Swmbo being the only one who earns any money round here at the moment  :(

Filled out another means form to show how who was earning what  :(

Asked the kind lady a straight question ............. Can you make any claim on any assets / money after the 12 months of the bankruptcy is up ?
The answer is (in my case)  NO  ;D ;D

As soon as the judge signs me off on the 9th May, thats it  :y :y
I can earn / win / inherit anything and the courts cannot touch it  :y :y

I suggest some of the folks on here who have been through what I have, have a word with a solicitor because the rules have definetly changed  ;)

Thanks for all the help and comments during this thread ............  :-* :-* ;D

That reminds me Steve, I bumped into my Chap over the weekend end and ask the questions.

The rules have changed over recent years, in your case you should be free from any claims in the future, as long as the Trustee has not lodged any interest in potential assets (as of now or in the future) during the bankrupt period, ie, Pensions, joint Savings etc, Property etc.

He did mention that if you wanted to be sure, ask your Trustee for confirmation of this and for them to confirm in writing to you closer to your discharge point.

Im sure your be fine, Steve.

Bloody hell, my day keeps getting better  ;D ;D

First the shed past its mot and when I get home, i've another letter from the insolvency service.

This one says .............. we accept we ain't going to get a penny out of you and so we are going to inform the courts and all your old creditors that we will be closeing our side of the case and not persuing you anymore  :y ;D ;D

With a little look, the courts might say enough is enough and discharge me early  ;D ;D
